Ottawa is named the best place to live, to work, and to invest in Canada, for the second year in a row!

Here is an optimistic outlook for our region, as reported in the MoneySense Magazine and other public media outlets. May it produce an economic boom for many more people in our area, again!

The report states: 

Ottawa has been named the best place to live in Canada by financial magazine MoneySense, although the publication's editor says he mainly focused on affordability factors. 

"People always groan at the idea of Ottawa being number one," editor Ian McGugan told CTV Newsnet (last) Tuesday.
"It really is the triumph of the B+ student. Universities always tell you that B or C students always end up ruling the world. And in some ways that's what happened with Ottawa. It was outstanding in absolutely nothing, but it was slightly above average in just about everything, and that put it in the top spot."    

MoneySense grouped Ottawa together with Gatineau for the top spot, and gave the area high marks for its quality of life:
       a.. Average family income: $85,475
       b.. Average house price: $250,123
       c.. Unemployment rate: 5.2 per cent
       d.. Doctors per 1,000: 2.6492

"This is the second year in a row that MoneySense has picked Ottawa as the number one city in Canada to live, to work and to invest," Ottawa Mayor Larry O'Brien told CTV's Mike Duffy Live.
"We know it, we enjoy it, and it's nice to see that on a very balanced and reasonable yardstick, other people that see that as well."

McGugan said the magazine awarded bonus points for sports teams and other elements that make communities exciting places to live. But he said economic factors were first in mind.
"People in Newfoundland always want us to somehow gauge the community spirit; people in Montreal always take us to task for not including culture; people in B.C. always whip us for not looking at natural beauty," he said. "There are these very subjective factors ... but our contention is that it's difficult to appreciate natural beauty, or culture, or a sense of community, if you don't have a job and you can't afford a house."

The worst place to live in Canada, according to the magazine, was Port Alberni, B.C., which ranked 154. It had more than double the unemployment rate as Ottawa, a lower average family income, but similar house prices:

       d.. Doctors per 1,000: 1.4626

Canada's major cities were spread out evenly throughout the list, with Vancouver, Halifax and Winnipeg joining Ottawa in the top 10:

        e.. Calgary: 35
       f.. Toronto: 51
        g.. Montreal: 82

"Homes in big cities are really becoming a stretch for most families," said McGugan. "Other factors that pull down big cities are a lack of doctors and a high crime rate."

A clean uncluttered home appeals to all buyers!

1.        Unclutter! Pack and store (or give away, if necessary) at least half of your personal effects. 

2.        Cut the lawn and re-sod, if needed. Trim shrubs. Prune and manage your front yard trees or plant a tree, if it has the space!. Clean stains from driveways and sidewalks. Remove all extra vehicles and other exterior clutter. 

3.        Pick up after your pets and repair all damage done by them.

4.        In the kitchen, clear away extra appliances and counter accessories. Remove extra dishes and knick-knacks. Clear fridge of magnets and artwork.

5.        Clean and organize your bathroom vanities, medicine cabinets (remove all prescriptions), counters and linen closets. 

6.        Replace unhealthy plants, minimize books on bookshelves, remove all old newspapers and magazines.

7.        Clear childrens’ play areas of most toys, organize and minimize closet items. Pack and store all (extra toys, clothes and  furniture) away from the house being sold.

8.        Go through your tool shed, garage and basement. Have everything safely packed, stacked up and organized.

9.        Clean and sanitize everything, to make every room smell as good as it looks. Scrub pet areas, nurseries, bathrooms and any smoking areas extra well.

10.     Wash windows inside and out; dismantle, if necessary. Hose down the siding and brick work around the house and chech if your water is draining away from your house, at the same time...

11.     Wash the inside of all cupboards. Clean vents and exhaust hoods. Clean all appliances inside and out.

12.     Replace shower stalls, sinks and/or toilet parts, if  needed. Refresh the caulking around all the fixtures and regrout.

13.     Have all carpets cleaned and/or replaced. Polish furniture and woodwork. Uncover, clean and polish all hardwood floors. 

14.     Have drapes and blinds professionally cleaned. 

15.     Repair or replace damaged window screens, and hardware.  Repaint damaged trim areas around doors, windows and roof areas. Replace and repaint damaged fencing.

16.     Repair leaky faucets. Replace old electrical wiring, defective light bulbs, broken electrical outlets and switch plates. Fill and paint any cracks in ceiling and walls. Check all appliances, furnace, hot water heater and laundry connections to ensure their working condition and repair as needed. Change filters and batteries.

17.     Use neutral  paint, decor and carpeting to create a home for any lifestyle. Decorate with bold color accents.

18.     Replace patterned shower curtains and towels with new ones in neutral or a single bright colour, unless your bathroom is monochromatic.

19.     Consider painting your cement basement and garage floors in a neutral colour.

20.     Help to create a mood, from fresh flowers to fresh baked goods smells. Freshen up daily with those chores that need to be done often.

I was talking to a nice lady today...

While I was distributing my flyers in one of my neighborhood streets, this nice older lady and her "unleashed fangy growling" dog were just coming out of the house... After I safely unfroze, I introduced myself and we started to small talk about Real Estate. She said that she had the"no soliciting" sign at her door, which I hadn't seen yet! She told me that Real estate people actually ask for way too much money with their percentage. She said: "Why should you get so much money for doing nothing other than putting a sign up for one day and the house gets sold by itself in a few days, in this neighborhood? Except for the "for sale by owners", they take longer for some reason..."

 I would say the same of doctors... you go see them, they say open your mouth and say ahhh, they look into your eyes and ears, tap here and there, and give you a prescription for pain reduction. Five minutes- max, when you find a doctor, that is... yet their bill is not questioned, when it has been questioned we have had doctors going elsewhere. Or, they can always ask for extra fees, if it's not covered by Health care....

I would say the same of lawyers, you go to their office and they start charging by the minute, as soon as you open your mouth... the same for other professionals, dentist, accountant, tax man, etc, etc... They ask for different prices, but always between a certain range.

Yet, we REALTORS are not allowed to earn this money, that we deserve for our super efficiency and great MULTIPLE LISTING SERVCICE co-operation, or to enjoy the fruits of our labor in peace, when things come together more easily for us.

Let's enumerate all the reasons why this fee is what it is...

Real estate pre-requisite courses: 1, 2, 3 (residential) = "approximately" $ 400.00 each course, Real Property law= $ 400.00, Real estate (commercial) = $ 620.00, 2 other elective related courses, $ 400.00 each, 24 continuing education units required every 2 years, at roughly $40.00 per 3 credits. This is for a basic salesperson license.

When the pre-requisites are taken care of, then, there are applications to fill and licenses to pay, RECO $ 250.00  per 2 year, CREA $ 150.00 per year, Errors&Omissions Insurance $ 160.00, per year, the local Real Estate Board to Maintain, $ 350.00 per year, Geowarehouse-Terranet- MPAC $100.00 a year. Percentage fees and dues for the Brokerage name, office use fees. Variable approximately $ 200.00 a month. Business per transaction fees, $50.00 per sale, charities per sale, variable. and dont forget that the requested fee from the seller also pays the buyer's Brokerage commission. The fee belongs to the Brokerages and it is then split as per our contract % with our Brokerages...

Then there is the cost of doing business, Gas, business cards, Brokerage name signs, for sale, sold, open house tent signs, date and time signs, directional signs, name riders, flyers, calendars, knick-knacks and promotional give-aways, advertising- on the trade papers, on tv, on the radio, on the road, kiosks, websites, trade shows and fairs, telephone directories, others...Yes the famous others, the times when we knock at doors, talk to strangers, ask for business, in all kinds of weather, 40 above to 40 below! You gotta have passion!!! Every salesperson must have many, if not most of these services in place to serve you, the public! It's just like having a buffet in a restaurant at a grand opening, you MUST have the food in place, whether the people come or not...it must look fresher and more appetizing than the restaurant next door, or the better service from the Brokerage/salesperson next door...

To come back to the fee, that isn't earned... Isn't it? What about all the times, we have shouldered the cost of your free advertising for months on end, when in spite of our better judgement and advice the client won't budge. What about the professional advice requested to get the house cleaned and in good repair. What about making perfect pictures to showcase the property to its best advantage, when the salesperson cares for her work. What about when the sellers want to keep the listing price higher, when we know that buyers will refuse to offer for it, and then blame the salesperson for the non-sale... If the price is perceived as low for the value - BY THE BUYERS - then, there will be a bidding war. If this outbidding doesn't happen, then the price is high!!

The Candian Competition Act and I as a Real estate salesperson.

To say that real estate is an easy money making business would be laughable if it weren't so deadly serious. As a real estate salesperson, I have a fiduciary duty to serve the public to the best of my knowledge and ability (and more), so that the public is always protected. The Canadian Competition Act keeps me and all other real estate salespeople/brokers/brokerages in check from taking advantage of the real estate market.

For example, as a real estate salesperson, if I were to have 2 or more bids from different clients for the same property and if I were to prefer one to the others, I should never push the one over the others. I should never use inside information to help the prefered one at the detriment of the others. I should never tell someone to abstain from bidding because I know that the price will come down due to the other's circumstances.

Competition Act Part VI: Offenses in relation to Competition 45. (1) Every one who conspires, combines, agrees or arranges with another person,(a) to limit unduly the facilities for transporting, producing, manufacturing, supplying, storing or dealing in any product, (b) to prevent, limit or lessen, unduly, the manufacture or production of a product or to enhance unreasonably the price thereof, c) to prevent or lessen, unduly, competition in the production, manufacture, purchase, barter, sale, storage, rental, transportation or supply of a product, or in the price of insurance on persons or property, or (d) to otherwise restrain or injure competition unduly, is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years or to a fine not exceeding ten million dollars or to both.

If I were to advertise a property situated in one area, but the same road also exists in a better neighborhood of another area, I should be extremely carefull that the correct area is represented so as not to mislead the public. If for any reason whatsoever, the public will be misled by either the wording or the intent of my advertisement, I could/would be charged with a criminal offense under this said Act.

Competition Act Part VI, 52. (1) No person shall, for the purpose of promoting, directly or indirectly, the supply or use of a product or for the purpose of promoting, directly or indirectly, any business interest, by any means whatever, knowingly or recklessly make a representation to the public that is false or misleading in a material respect.

This practice sometimes "happens" in offices to attract unsuspecting prospective buyer clients. How do you find a good REALTOR®?  Do you keep calling the same agent for all your transactions, all your friends' transactions, and everyone else that you hear about...who needs an agent? The condo, is there value in it or not?

The Condominium Corporation is not a legal entity until it is registered through the invocation of the Condominium Act, under Provincial law jurisdiction, whereby both the constitution declaration and description documents (land survey, representations of units diagrams, and improvements) are registered. This creates a Corporation without share capital, where members are unit holders. Mortgagees and lien holders must consent to this invocation.

Residential condos are a special type of home where all the exterior and/or which are non excusively used areas, are common use areas.The land and other common use areas belong to all the tenants-in-common, indivisible but mostly calculated as a % of the whole area. This calculation is determined on the description documents. The individually held units, if there are such units, are also a percentage of the whole - in terms of space held... So the calculation of the rightfull share % of the common areas to the whole, is multiplied by the % share of the whole - held by each individual. The price is calculated by establishing the budget reqiurements for the following years and setting aside some of this money for major repairs over time. This total required amount is then multiplied by the percentage held by each individual, and this establishes the condo fee to be paid by each tenant-in-common to upkeep the common elements of the condos. 

This type of Corporation does not permit limited liability. In effect, the owners are personally liable for all the corporation's debts and obligations. So much so, that any late fees have priority of payment even over the mortgage owed individually. The status certificate is of utmost importance, to see the present health of the condo Corporation, and is a buyer's expense, together with a building inspection - for his own protection.  The whole process is more complicated, of course, and this simplified blog does not constitute legal advice, but should only be viewed as interesting information.

On the plus side, a condo owner does not need to worry about exterior maintenance, building insurance, the water bill and taxes. These items are usually included in the fees, but not necessarily, so the documents must be scrutinized by your lawyer...

Some people think it's the best thing since sliced bread, and others think it's a major rip-off... What do you think about condos?

The daughter looked at her mother baffled, then she said: "A cooked carrot, a boiled egg and tea". But, the mother insisted: "What else did you observe?" I don't know", said the girl. So the mother tells her this:

"These three items all suffered the fate of boiling water, yet they all reacted differently, the carrot was a hard core strong type and with the pain, it became soft and fell apart, the egg was all soft and gooey, with just a very thin protective shell, but having undergone the boiling water, it became hard and brittle. But the tea leaves worked through the heat and changed the water without interfering, as well as themselves...

I was wondering...about the state of real estate

I read about the state of real estate in the United States, and what I read makes me shiver and blanch. Literally! People can get a real estate license in weeks, instead of 18 months of committed study!?!? it's no wonder people are unhappy about the industry. And this unhappiness, of course, reflects badly on all real estate agents, including REALTOR® agents in Canada.

I also read how a do-it yourself website is saving thousands of dollars, to the people whom they serve. They will help with the negotiations of the contract, after the buyers have done the basic looking for their home on the internet! The buyers are asked to let the selling agent take care of the showings, that would be like "have to get paid" extra for this kind of work, for these company agents... They seem to do all that work, for a mere two thousand dollars, (sorry I stand corrected $3,000.00) instead of the fabled 6% that regular real estate agents seem to abscond with... and the difference is returned in a cheque, to the clients who are supposedly extatic with this state of affairs...

What is wrong with this picture??? It seems to me that  - if this Company is returning said money, with the fanfare of such generosity, it means that THEY are charging this fee, in the first place... Maybe, possibly, yes? Is it charged beforehand, maybe advanced with only 6% interest...? How long are they keeping this money for? Are they also giving interest, for the time that they keep it? Is it in a "in trust account", like here in Canada, guarded and kept safe for our clients?

So, who exactly are they tarring and feathering? And pointing fingers at agents for charging 6%? Just because they do it, does not make it the normal thing to do!!
